U.S. Court of Appeals Case No: 05-1865
Western District of Missouri
[PUBLISHED] [Loken, Author, with Wollman and Riley, Circuit Judges]
Criminal case - Sentencing. Substantial downward variance resulted in
a sentence which does not accurately reflect the seriousness of
defendant's crime and does not afford adequate deterrence or protect the
public; further, the sentence fails to avoid unwarranted sentencing
disparity among defendants with similar criminal histories who have
illegally possessed stolen firearms to commit armed robberies; case
remanded for resentencing.
