Civil case - Education law. Both the administrative hearing board and the district court erred when they assigned the burden of proving defendant's child had received a Free Appropriate Public Education to the school district, as the burden of proof in an action under the Individuals with Disabilities Education Act lies with the party initiating the challenge to the Individualized Education Plan; since the parents brought the challenge, the burden of proof was on them, and it was reversible error to assign it the school district; the district court did not err in precluding the district from supplementing the administrative record or in finding that the administrative agency did not err in refusing to recuse two of its panel members.
