U.S. Court of Appeals Case No: 05-1978
Northern District of Iowa
[PUBLISHED] [Murphy, Author, with Arnold and Gruender, Circuit Judges]
Criminal case - criminal law and sentencing. District court did not err
in denying defendant's recusal motion, as the complained-of comments
do not display a deep-seated favoritism or antagonism that would make
fair judgment impossible; district court did not err in finding defendant
was competent to stand trial; district court properly calculated the
applicable Guidelines range and did not err in imposing enhancements for
possession of a firearm and perjury; no error in denying a mitigating role
adjustment; life sentence was a reasonable sentence.
