Civil case - Civil rights. District court did not err in dismissing school
district from Section 1983 action arising out of a student's death as the
complaint failed to allege any policy or custom of the district which
caused an alleged constitutional violation; with respect to the band leader
defendant who was in charge of the school trip, the district court did not
err in dismissing the action as the student was not within the limited class
of persons to whom the state owes a constitutional duty to provide some
degree of medical care; voluntary participation in an out-of-town
extracurricular activity does not impose a constitutional duty on state
actors to care for individuals who participate in the event.
