U.S. Court of Appeals Case No: 05-2111
District of Nebraska
[PUBLISHED] [Colloton, Author, with Riley and John R. Gibson, Circuit Judges]
Criminal case - criminal law. Search of passenger compartment of
vehicle was a contemporaneous incident of defendant's lawful arrest,
and the district court erred in suppressing the handguns discovered
during the search; even though an hour had elapsed between the search
and defendant's detention, under the facts of the case, the search could
still reasonably be categorized as contemporaneous. Judge Gibson, dissenting.
