U.S. Court of Appeals Case No: 05-2201
Eastern District of Missouri
[PUBLISHED] [Colloton, Author, with Riley and Hansen, Circuit Judges]
Criminal Case - conviction. District court did not abuse its discretion
in admitting testimony of co-defendant about prior drug dealings to show
knowledge; limiting instruction guarded against unfair prejudice.
Evidence was sufficient to establish conspiracy to possess
pseudoephedrine with reason to believe it would be used to manufacture
methamphetamine during the life of conspiracy based on role as supplier
and broker of chemicals. Ample evidence supported enhancement for
"use" of a minor; knowledge of age is not required. Role of offense
adjustment was not error based on defendant's instructions to others to
obtain pseudoephedrine. Quantity of drugs attributable to defendant was
reasonably foreseeable.
