U.S. Court of Appeals Case No: 05-2220
and No: 05-2429
Western District of Missouri
[PUBLISHED] [Melloy, Author, with Loken, Chief Judge, and
McMillian, Circuit Judge]
Civil case - employment discrimination. Plaintiff's evidence failed to
support an award of punitive damages, and the district court did not err in
setting aside the jury's award of punitive damages; doctrine of res
judicata did not bar this suit, as the conduct complained of in an earlier
lawsuit was sufficiently dissimilar to the claims in this suit; evidence was
sufficient to submit the issue of racial discrimination to the jury and for
the jury to have found in favor of plaintiff.
