U.S. Court of Appeals Case No: 05-2248
Northern District of Iowa
[PUBLISHED] [Murphy, Author, with McMillian and Gruender, Circuit Judges]
Criminal case - criminal law and sentencing. District court did not err
in refusing to permit defendant to impeach witness about a dismissed
charge of filing a false report as the evidence would not have impeached
the witness and would not have been admissible under Rule 404(b);
district court did not err in excluding hearsay out of court statements by
defendant and another man; evidence was sufficient to support drug
convictions; district court did not err in imposing an enhancement for
obstruction of justice based on defendant's perjured testimony; sentence
was not unreasonable.
