U.S. Court of Appeals Case No: 05-2249
and No: 05-2973
Northern District of Iowa
[PUBLISHED] [Melloy, Author, with Bye and Heaney, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient to
support convictions for violation of the Hobbs Act and for firearm
offenses; pre-identification procedures did not taint identification by
persons familiar with the defendants who viewed photos and indicated
the men in the photos were the defendants; district court erred in
imposing a life sentence on defendant Wilson, as his prior conviction for
burglary did not involve proof of violence, threats of violence or
possession of a weapon; as a result, the conviction did not qualify as a
serious violent felony under 18 U.S.C. Sec. 3559(c)(1)(A)(i). Judge
Heaney, concurring.
