U.S. Court of Appeals Case No: 05-2448
Western District of Missouri
[PUBLISHED] [Riley, Author, with Melloy and Benton, Circuit Judges]
Civil case - Public employees. In case involving claims that plaintiff
was fired for exercising his First Amendment rights, the district court did
not err in limiting the number of instances of supposed protected speech
submitted to the jury, as the other instances plaintiff wanted the court to
submit did not qualify as protected speech; district court did not err
applying the Pickering test and in directing judgment against plaintiff.
