U.S. Court of Appeals Case No: 05-2461
Western District of Missouri
[PUBLISHED] [Gruender, Author, with Colloton and Heaney, Circuit Judges]
Criminal case - Sentencing. By acknowledging at sentencing that the
presentence report was correct, defendant withdrew his objections to the
report and waived his right to argue those objections on appeal; conduct
charged in dismissed indictment was the same course of conduct
described in the information to which defendant pleaded guilty, and the
district court could consider the conduct contained in the dismissed
indictment in setting sentence.
