U.S. Court of Appeals Case No: 05-2480
Northern District of Iowa
[PUBLISHED] [Arnold, Author, with Wollman and John Gibson, Circuit Judges]
Criminal case - Criminal law and sentencing. The government did not
intentionally elicit the information which led to a mistrial in defendant's
first trial, and his retrial was not barred by principals of double jeopardy;
filing of superseding indictment before retrial did not violate due process;
evidence was sufficient to support convictions for wire fraud; jury
instructions were not erroneous; district court did not err in calculating
the amount of the loss; district court did not err in imposing a two-level
enhancement for obstruction of justice.
