U.S. Court of Appeals Case No: 05-2513
District of Minnesota
[PUBLISHED] [Melloy, Author, with Wollman and Lay, Circuit Judges]
Civil case - Employment discrimination. District court erred in
concluding the harassment plaintiff suffered was not severe or pervasive,
but the court correctly determine that the employer's response was
adequate to grant summary judgment on plaintiff's hostile work
environment claim; district court did not err in granting employer
summary judgment on plaintiff's claim of discriminatory discharge as
plaintiff failed to show any evidence that gave rise to an inference of
discrimination; assuming plaintiff has provided sufficient evidence to
make a prima facie case that she was terminated in retaliation for
complaining about racial harassment, she failed to show the legitimate,
non-discriminatory ground offered for her termination was a pretext for
retaliation. Judge Lay, concurring in part and dissenting in part.
