U.S. Court of Appeals Case No: 05-2560
Northern District of Iowa
[PUBLISHED] [Smith, Author, with Hansen, Circuit Judges and Bogue,
District Judge]
Criminal Case - venue. Conspiracy to distribute methamphetamine
within protected location was properly brought in Northern District of
Iowa, because sufficient evidence presented that overt act in furtherance
of conspiracy took place there. 132-month sentence is affirmed, as
calculation of drug quantity was not clearly erroneous, district court did
not err in refusing to grant downward departure for minor role or
acceptance of responsibility, and sentence below the guidelines range
was not unreasonable.
