U.S. Court of Appeals Case No: 05-2594
and No: 05-2627
District of Nebraska
[PUBLISHED] [Wollman, Author, with Fagg and Arnold, Circuit Judges]
Criminal case - Criminal law and sentencing. Evidence was sufficient
to support defendant's convictions of drug and firearms charges; on the
government's cross-appeal, the district court erred in requiring beyond-a-
reasonable-doubt standard of proof with respect to drug quantity
determinations, and the case is remanded for a determination of drug
quantity under a preponderance of the evidence standard.
