U.S. Court of Appeals Case No: 05-2603
and No: 05-2644
District of Minnesota
[PUBLISHED] [Murphy, Author, with Bowman and Benton, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient
to support Nancy Bistrup's conviction on bank and mail fraud charges, as
well as on the charge of making misrepresentations to a financial
institution; no error admitting testimony of a handwriting expert; no error
in refusing to allow Nancy to introduce evidence of her husband Alan's
extramarital affair; district court did not err in imposing a sophisticated-
means enhancement against defendant Alan Bistrup; no error in imposing
an enhancement for Alan's role in the offense; district court sufficiently
stated its reasons for imposing Alan's 188 month sentence.
