U.S. Court of Appeals Case No: 05-2620
District of Minnesota
[PUBLISHED] [Wollman, Author, with Arnold and Gruender, Circuit Judges]
Civil case - Fraud and Breach of Contract. District court did not err in
granting defendant summary judgment on plaintiff's claims for fraudulent
misrepresentation as plaintiff could not reasonably rely on the
representation in question as it was contradicted by the express language
of the contract addendum at issue; plaintiff also failed to establish fraud
by omission as defendant did not conceal any material fact relating to its
future use of the plaintiff's image; district court did not err in inter-
preting the parties' contact or in granting defendant's motion for summary
judgment on plaintiff's breach of contract claims.
