U.S. Court of Appeals Case No: 05-2698
and No: 05-2859
Western District of Arkansas
[PUBLISHED] [Colloton, Author, with Melloy and Benton, Circuit Judges]
Criminal case - criminal law and Sentencing. Warrant to search
defendants' residence for weapons was supported by probable cause and
officers acted in good faith in acting upon warrant; police were not
required to obtain a warrant to conduct a helicopter flyover of defendants'
property; even if the officers' reliance on the warrant was not objectively
reasonable, the evidence would have been inevitably discovered; district
court did not err in determining defendant Whatley was not eligible for
safety-valve sentencing because he possessed firearms in connection with
the underlying drug offense.
