U.S. Court of Appeals Case No: 05-2727
Western District of Missouri
[PUBLISHED] [Melloy, Author, with Colloton and Benton, Circuit Judges]
Criminal Case - conviction. Conviction for possessing with intent to
distribute marijuana is affirmed. Out-of-court statements made by
interpreter who is also law enforcement officer raises hearsay concerns,
but any error was harmless, as testimony was cumulative and defendant
had opportunity to cross-examine declarant. Prosecutor's explanation
during closing argument of definition of "distribution" that was not part
of instructions was harmless error and thus did not constitute an abuse of
discretion by district court to allow.
