U.S. Court of Appeals Case No: 05-2777
District of Minnesota
[PUBLISHED] [Gruender, Author, with Wollman and Arnold, Circuit Judges]
Civil case - civil rights. Assuming without deciding that plaintiff was
entitled to a name-clearing hearing based on a city councilperson's
criticisms, his meeting with the city council one week after the
criticism was made constituted a sufficient pre-termination name-clearing
hearing; plaintiff never requested a post-termination name-clearing hearing,
and failure to do so bars recovery for deprivation of a name-clearing
hearing.
