Civil case - torts. In products liability action involving defective design
of an industrial laminator, Minnesota would follow the general rule that a
manufacturer is not liable for design defects when it builds a product in
accordance with customer specifications; here, however, plaintiff
presented adequate facts establishing a material dispute as to whether the
manufacturer participated in the design of the parts of the machine she
alleged caused her injury, and the district court erred in granting the
manufacturer's motion for summary judgment; plaintiff also established
genuine issues of material fact regarding the cause and foreseeability of
her injury; plaintiff presented sufficient evidence to show that the
machine was defectively designed and that the defect existed when the
machine left defendant's control.
