U.S. Court of Appeals Case No: 05-2924
   Immigration & Naturalization Service
[PUBLISHED] [Melloy, Author, with Riley and Shepherd, Circuit
   Judges]
Petition for review - Immigration. Board of Immigration Appeal did not abuse its discretion in denying motion to reconsider an order denying a motion to reopen her asylum proceedings; petitioner had notice that the Board considered her first set of medical records to lack credibility and she failed to prove that the second set she wanted the Board to consider were previously unavailable; to the extent a petitioner may have a post- hearing right to rehabilitate her credibility, it would not apply when the petitioner has more than one year's notice prior to a hearing that a document is fraudulent and fails to take any substantial steps to rectify or explain the fraud during that time.
