U.S. Court of Appeals Case No: 05-2989
and No: 05-3001
Southern District of Iowa
[PUBLISHED] [Loken, Author, with Bowman and Smith, Circuit Judges]
Criminal case - criminal law. District court did not abuse its discretion
in refusing defendant's requests for instructions on multiple conspiracies
and his theory that he was an independent contractor rather than a
conspirator; however the tax laws might describe defendant's relationship
with the leader of the conspiracy, the evidence was more than sufficient
to show he joined a conspiracy to distribute ecstasy.
