Criminal Case - conviction. Evidence to support conspiracy to commit
murder for hire was sufficient, as it was reasonable for the jury to
conclude defendant was part of the conspiracy and ample evidence of
interstate phone calls was offered to prove interstate connection. District
court did not err in denying motion to adjourn trial to take a deposition to
preserve testimony of pregnant woman because testimony was not
material. Dismissal of emotionally distraught juror was not an abuse of
discretion. Exclusion of codefendant's dismissed indictment was not an
abuse of discretion, as its admission would create the potential denial of a
fair trial.
