U.S. Court of Appeals Case No: 05-3037
District of Nebraska
[PUBLISHED] [Riley, Author, with Melloy and Benton, Circuit Judges]
Civil case - insurance law. District court did not err in finding the
commercial general liability policy issued by National American did not
provide primary coverage for the accident in question; nor did the district
court err in holding that National American's auto policy provided
excess, rather than primary or co-primary coverage, and that Republic's
policy provided primary coverage; National American was not estopped
from seeking equitable subrogation from Republic.
