Criminal Case - conviction and sentence. District court did not abuse its
discretion in refusing to permit a defense expert to interview victim of
alleged aggravated sexual abuse. Defendant had access to videotaped
statement, could cross-examine interviewer and victim, and could have
supplied expert addressing weakness of interview techniques.
Determination that defendant was a career offender was not error, as
conviction for engaging and attempting to engage knowingly in a sexual
act with a person under age 12 constitutes a crime of violence because it
involves a substantial risk that physical force may be used.
