U.S. Court of Appeals Case No: 05-3078
Immigration & Naturalization Service
[PUBLISHED] [Melloy, Author, with Arnold and Bye, Circuit Judges]
Petition for Review - Immigration. Immigration Judge did not abuse
his discretion by denying petitioner's motion to reconsider an order
denying his motion to reopen his case based on a claim of ineffective
assistance of counsel; the motion to reopen did not meet the requirements
for such a motion and the motion to reconsider was untimely; claim that
ineffective assistance of counsel, lack of notice and procedural hurdles
denied defendant due process rejected; Board did not err in refusing to
reopen the case on the basis of changed country conditions in Lebanon.
