U.S. Court of Appeals Case No: 05-3122
Eastern District of Arkansas
[PUBLISHED] [Smith, Author, with Arnold and John R. Gibson, Circuit
Judges]
Criminal Case - conviction and sentence. Convictions for mail fraud
and wire fraud, money laundering and false statements are affirmed.
District court did not abuse its discretion in refusing to suppress
incriminating statements, as no right to counsel attached at the time she
made the statements and were not made during the course of specific plea
deals; did not err in removing counsel after defendant declined to waive
actual conflict of interest; did not err in denying defendant right to
proceed pro se four days before trial, as request was not timely and
request was to delay or disrupt; did not abuse its discretion in admitting
prior bad act evidence because of similarity of acts and use of limiting
instruction; evidence was sufficient to support convictions; admission of
prison records was not an abuse of discretion; omission of forfeiture in
judgment was clerical error; sentence was not unreasonable.
Enhancements for multiple victim, use of charitable organization,
sophisticated means, and obstruction of justice were proper.
