U.S. Court of Appeals Case No: 05-3142
   District of Minnesota
[PUBLISHED] [Bowman, Author, with Murphy and Benton, Circuit Judges]
Criminal case - Sentencing. District court imposed a unreasonable sentence when it sentenced defendant to probation and community service but did not impose a prison sentence; when it imposed the sentence, the district court failed to accord sufficient weight to the Guidelines range, the seriousness of the offense, the need for deterrence and the need to avoid unwarranted sentencing disparities.
