U.S. Court of Appeals Case No: 05-3221
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Chief Judge Loken, Author, with Bye and Shepherd,
   Circuit Judges]
Habeas Case - section 2254. Claim that Sixth Amendment right to public trial was violated when courtroom was partially closed during minor victim's testimony was procedurally defaulted where defendant agreed to partial closure of the courtroom. State court's decision that defendant waived his right to a public trial was an independent and adequate state ground precluding the grant of federal habeas relief. Judge Bye dissents on whether the waiver rule was firmly established or regularly followed in Minnesota.
