Minnesota state court decisions was res judicata as to Compaq's counterclaim for coverage under the Tech Errors and Omissions policy in question, as the Minnesota courts had found that St. Paul had no duty to defend; St. Paul made an effective reservation of rights and may recover payments it made before it was determined there was no coverage.
