judicata as to Compaq's counterclaim for coverage under the Tech Errors
and Omissions policy in question, as the Minnesota courts had found that
St. Paul had no duty to defend; St. Paul made an effective reservation of
rights and may recover payments it made before it was determined there
was no coverage.
