U.S. Court of Appeals Case No: 05-3306
Eastern District of Arkansas
[PUBLISHED] [Arnold, Author, with Chief Judge Loken and Beam, Circuit
Judges]
Habeas Corpus - ineffective assistance. After pleading guilty to first-
degree murder in exchange for 32 ? year sentence, defendant claimed
ineffective assistance of counsel upon learning he had to serve 70% of the
sentence. Denial of habeas relief is affirmed. Counsel stated that he told
defendant he should be prepared to serve the full amount of the sentence
and that parole was up to the state officials; there is no reason to believe
he would have made a different choice had he been told he had to serve
70% of sentence. Appellate court decisions in Hill II or Hill III cannot
serve as bases for conclusion about reasonableness of state decision.
