[PUBLISHED] [Chief Judge Loken, Author, with John R. Gibson and
Colloton, Circuit Judges]
Petition for Review - immigration. Under INS v. St. Cyr,
petitioner was eligible for discretionary waiver of deportation
based on his convictions for domestic violence, but drug
conviction was aggravated felony which precludes section 240A
cancellation of removal. Court retained jurisdiction because removal
order was based on domestic violence conviction and constitutional
claims were asserted. Petition for review is denied.
