U.S. Court of Appeals Case No: 05-3394
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Smith, Author, with Melloy and Benton, Circuit
Judges]
Prisoner case - prisoner civil rights. State produced medical records
that the care provided was adequate, and plaintiff could not create a
question of fact by merely stating that the treatment was not adequate;
plaintiff failed to adduce any proof that the defendants retaliated against
him for refusing to visit the county dentist; plaintiff lacked standing to
challenge the defendants' "pull-teeth-only" policy as he was no longer
incarcerated at the jail and there was no reason to expect he would ever
be detained there again; discovery rulings were not an abuse of the trial
court's discretion.
