U.S. Court of Appeals Case No: 05-3517
and No: 05-3931
and No: 05-3590
District of Nebraska
[PUBLISHED] [Bowman, Author, with Loken, Chief Judge, and Bye,
Circuit Judge]
Criminal case - criminal law. Defendants' van was speeding, and the
officer had probable cause to make a traffic stop; whether officer had
taken all steps required by Nebraska law to assure the admissibility of his
radar gun readings in a speeding prosecution in Nebraska state court is
not relevant to the issue of probable cause in this federal drug
prosecution; officer had authority to extend the stop to question
passengers of the rented van; district court did not err in concluding that
the after the traffic stop ended, officer's questioning did not constitute an
illegal detention but was merely a consensual encounter; driver
authorized in rental agreement gave a valid consent to search the van.
