U.S. Court of Appeals Case No: 05-3545
District of Nebraska
[PUBLISHED] [Gruender, Author, with John R. Gibson and Colloton,
Circuit Judges]
Criminal case - criminal law. District court did not err in finding
defendant voluntarily consented to a search of his truck; trooper was
acting within the scope of the consent when he inserted a wire probe into
the open drain under the truck bed and punctured plastic wrap with the
probe; length of the search (about 45 minutes) did not exceed the scope
of the consent; defendant's statement that he did not have a key to the
tonneau cover on the truck bed did not revoke his consent.
