U.S. Court of Appeals Case No: 05-3599
   Northern District of Iowa
[PUBLISHED] [Gruender, Author, with Colloton and Heaney, Circuit Judges]
Criminal case - Criminal law. District court did not err in holding defendant was competent to enter a guilty plea; fact that former assistant U.S. Attorney who indicted defendant was now serving as the district court's law clerk and acted as courtroom deputy at a motion hearing did not require the district court judge to recuse herself; the law clerk performed only ministerial functions at the hearing and was screened from any substantive participation in the case.
