U.S. Court of Appeals Case No: 05-3750
and No: 06-1701
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Riley, Author, with Bowman and Arnold, Circuit
Judges]
Prisoner case - prisoner civil rights. Because the two claims White
sought to assert - a post-conviction petition and a Section 1983 action -
were frivolous, he could not show that the contract-attorney system in
place at the penitentiary actually caused him an injury, and the district
court erred in entering judgment for White on his claim that the system
violated his constitutional right to access to the court.
