Civil Case - Diversity - contract. District court's grant of summary
judgment to insurer, concluding P & O was not an intended beneficiary of
the policy and SMG did not have an insurable interest in the cargo at the
time of the seizure by Russian officials, is affirmed. Title passed at
time and place of shipment under C.I F. shipment terms. Claim that CIF
shipment was typographical error is not considered because it is raised
for the first time on appeal. Parol evidence cannot be considered to show
CIF contrary to intent of parties. Judge Beam dissents.
