U.S. Court of Appeals Case No: 05-3782
District of South Dakota
[PUBLISHED] [Bye, Author, with Riley and Smith, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient
to support a conviction for second degree murder; court did not err in
excluding evidence relating to specific instances of the victim's violent
conduct as the victim's violent character is not an essential element of
the claim of self-defense; the 135 month sentence the court imposed for
the second-degree murder conviction was not unreasonable; discretionary
denial of requests for downward departure was unreviewable on appeal.
