U.S. Court of Appeals Case No: 05-3788
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Beam, Circuit Judge
Criminal case - Criminal law and sentencing. Evidence was sufficient
to support convictions for conspiracy and possession of
methamphetamine with intent to distribute; evidence of violent acts
committed in furtherance of conspiracy was admissible; no error in
failing to give curative instruction concerning defendant's co-counsel's
passing references to a kidnaping; district court did not err in finding
defendant was a career criminal as his Minnesota conviction for
attempted third degree burglary was properly classified as a crime of
violence; ex post facto challenge to Booker rejected.
