Civil Case - FOTETA. Termination of commercial vehicle driver for
refusing to submit to federally mandated random drug test is affirmed.
Although termination was not mandated by FOTETA, termination was
not prohibited by Minnesota Drug and Alcohol Testing in the Workplace
Act. There is no need to decide whether FOTETA preempts Minnesota
statute.
