Civil Case - antitrust. Minnesota consumers claimed drug
companies unlawfully conspired to suppress importation of
Canadian prescription drugs for personal use. District
court's dismissal of federal antitrust claim and refusal
to exercise supplemental jurisdiction over state law claims is
affirmed. Drugs imported from Canada are not labeled in conformity
with federal law, and are unapproved under Federal Food Drug, and
Cosmetic Act and thus are prohibited. Plaintiffs failed to show antitrust
standing to pursue federal antitrust claims, as conduct of defendants did
not cause an injury of the type the antitrust laws were designed to
remedy. District court did not abuse its discretion in declining to
exercise supplemental jurisdiction over state law claims.
