Criminal case - Sentencing. District court erred in sentencing defendant
to probation following his conviction for being a felon in possession of
a firearm and ammunition and for being a drug user in possession of a
firearm, as the circumstances present in the case were not the kind of
extraordinary circumstances which would justify a 100% downward
variance from the bottom of the applicable guidelines range. Judge
Bright, dissenting.
