U.S. Court of Appeals Case No: 05-3963
and No: 05-4013
Eastern District of Missouri
[PUBLISHED][Loken, Author, with Melloy and Colloton, Circuit Judges]
Prisoner case - habeas. District court erred in granting habeas relief on
claim that Helmig's constitutional rights were violated when the jurors
in his state murder trial obtained and consulted during deliberations a
Missouri highway map that was not introduced into evidence at trial;
Helmig failed to prove prejudice because there was no reasonable
probability that a reasonable juror would have reached a different verdict
without the map; district court did not err in rejecting Helmig's claims
of ineffective assistance of counsel, as the state courts' handling of
the issues was neither contrary to nor an unreasonable interpretation of
clearly established Sixth Amendment precedents.
