U.S. Court of Appeals Case No: 05-3981
District of Minnesota
[PUBLISHED] [Benton, Author, with Murphy and Beam, Circuit Judges]
Civil case - civil rights. District court did not err in denying jail
officers' motion for summary judgment based on qualified immunity as
the facts, viewed most favorably to plaintiff, showed the officers knew
plaintiff's deceased husband was at high risk of heart failure and
disregarded it, thereby violating his Eighth Amendment rights; officers
were not entitled to official immunity under Minnesota law as they failed
to follow their ministerial duties.
