U.S. Court of Appeals Case No: 05-4131
Immigration & Naturalization Service
[PUBLISHED] [Smith, Author, with Chief Judge Loken and Gruender,
Circuit Judges]
Petition for Review - immigration. Decision denying Chinese citizen
asylum based on violating China's one-child policy and his ex-wife's
sterilization was supported by substantial evidence. The immigration
judge's credibility findings were supported in the record. Alien did not
prove ex-wife's sterilization was forced. Court lacks jurisdiction over
due process claim, as it was not raised before Board. Withholding of
removal and convention against torture claims also fail.
