U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Smith, Circuit Judge]
Criminal case - criminal law and sentencing. District court did not err
in denying defendant Ross's motion to suppress his statements, as the
evidence showed Ross's will was not overborne and that his statements to
investigators were knowing and voluntary; evidence was sufficient to
support drug conspiracy conviction; district court did not err in limiting
cross-examination of a government witness concerning nature of a
previous conviction for a sexual offense; drug quantity findings were not
erroneous; no error in denying defendant Judon's request for a minor-role
reduction; district court erred in rejecting the 100:1 quantity ratio for
crack and in substituting a 20:1 ratio; case remanded for resentencing.
