U.S. Court of Appeals Case No: 05-4304
Eastern District of Missouri
[PUBLISHED] [Colloton, Author, with Murphy and Melloy, Circuit Judges]
Criminal case - criminal law and sentencing. Defendant's Missouri
conviction for unlawful use of a weapon was properly counted as a crime
of violence for purposes of the career offender guideline; district court
may find the existence of a prior conviction and determine whether it is a
crime of violence without violating a defendant's Sixth Amendment
rights; district court complied with Rule 11(b)(1)(M) at the plea
agreement; sentence was reasonable in light of defendant's history of
violence, drug use and probation violations; claim of ineffective
assistance of counsel should be brought in a Section 2255 as the record
was not developed enough for review of the question in this direct appeal.
