Criminal case - criminal law and sentencing. Pretrial identification
did not violate defendant's rights; evidence was sufficient to support
conviction for being a felon in possession of a firearm; imposition of
both a 4 level enhancement of use of a firearm in connection with another
felony and an upward departure for causing substantial risk of harm to
multiple victims did not constitute double counting as the harms are not
identical and neither the enhancement nor the upward departure fully
accounted for the harm addressed by the other.
